A POLÍTICA DE EDUCAÇÃO INFANTIL EM MANAUS E A JUDICIALIZAÇÃO DO DIREITO À CRECHE

This article analyzes early childhood education policy in Manaus through the Public Civil Action (ACP) filed in 2014 by the Public Prosecutor’s Office of Amazonas State and Silva’s doctoral thesis (2021). The aim is to understand how the judicialization of the right to nursery education emerges as a response to the city’s historical omissions, articulating legal grounds, budgetary analysis, and theoretical frameworks such as the policy cycle (BALL; BOWE, 1992; BALL, 1994) and the concept of subjective public right (CURY, 2002; 2008). It is argued that the ACP represents a paradigmatic case of structural judicialization, which exposes both the insufficiency of municipal policies and the limits of the Judiciary in fully guaranteeing children’s rights. It concludes that overcoming the deficit requires budgetary priority, territorial planning, and political commitment, otherwise the right will continue to be guaranteed only by external pressures.
