Analise sobre a democracia brasileira da redemocratização aos dias atuais

Abstract

This article analyzes the repeated tests of resistance to which Brazilian democracy has been subjected since redemocratization, highlighting the historical weight of the negotiated transition between civilians and the military and its political, legal, and institutional consequences. The text proposes a critical reading of the 1988 Federal Constitution as the result of a broad agreement of ideological convergences, while also examining the successive crises that have tested its vitality—from the impeachment of Collor to the attacks of Bolsonaro's supporters on republican institutions. The analysis shows that, although Brazil has overcome the temptations of a military dictatorship, new risks of a judicial nature are emerging, resulting from judicial protagonism and the exacerbated activism of part of the judiciary, which threatens the balance of powers and challenges the democratic pact. Brazilian democracy, therefore, remains tested, but resilient, sustained by the legitimacy of its Constitution and the maturity of its republican institutions.
